Terms and Conditions

1. Scope

These General Terms and Conditions (GTC) apply to all contracts for digital services between Energyforecast.de (hereinafter "Provider") and customers.

A consumer within the meaning of these GTC is any natural person who concludes a legal transaction for a purpose that is predominantly neither commercial nor self-employed in nature.

An entrepreneur within the meaning of these GTC is any natural or legal person or partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.

2. Contracting party

The contract is concluded with Energyforecast.de, owner: Moritz Mair, Lindenweg 20, 64291 Darmstadt, Germany.

3. Conclusion of contract

3.1. The presentation of services in the online shop does not constitute a legally binding offer, but merely an invitation to order.

3.2. By clicking the Buy button, you place a binding order for the services listed on the order page. Your contract is concluded when we accept your order by sending an order confirmation by email immediately after receiving your order.

4. Right of withdrawal

4.1. If you are a consumer (not a legal entity or business), you have a right of withdrawal in accordance with the statutory provisions. Entrepreneurs do not have a right of withdrawal.

4.2. For digital services not delivered on a physical data carrier, the right of withdrawal expires once the Provider has begun performing the contract.

4.3. Otherwise, the statutory provisions on the right of withdrawal apply to consumers.

5. Prices and subscription

5.1. The prices stated on the product pages include the applicable VAT and all other price components.

5.2. The digital service is offered as an annual subscription. Prices vary depending on the selected plan (Pro or Business) and are shown on the respective product page.

5.3. The subscription renews automatically for another year unless cancelled.

5.4. Payment for the first year is due immediately upon conclusion of the contract. For subsequent years, payment is due on the anniversary of the contract conclusion.

5.5. Existing customers who made a one-time payment of €10.00 before 13 November 2025 receive lifetime access with no further payment obligation (Legacy plan).

5.6. The Provider reserves the right to change subscription prices at appropriate times. Price increases will be announced by email at least 6 weeks before they take effect. In the event of a price increase, you have the right to terminate the subscription extraordinarily at the time the price increase takes effect. If the subscription is not cancelled, the new pricing applies from the next renewal date.

6. Provision of services

6.1. Digital services are provided exclusively online.

6.2. Provision generally occurs immediately upon conclusion of the contract or receipt of payment, unless otherwise agreed.

7. Payment

7.1. Payment is made using the payment methods offered during the order process. Payment is processed via mollie.com.

7.2. The digital service is provided upon receipt of payment, unless otherwise agreed.

8. Cancellation

8.1. The subscription can be cancelled at any time with effect from the end of the current term.

8.2. Cancellation can be done via the subscription management page in the customer area.

8.3. Upon cancellation, access to the service ends at the expiry of the already paid period. No pro-rata refund is made.

8.4. Legacy customers (contract concluded before 13 November 2025) have lifetime access and do not need to cancel.

9. Usage rights

9.1. By purchasing the digital service, you receive a simple, non-transferable right of use for the scope of use provided for in the booked plan (personal or commercial). No further rights of use are granted.

9.2. You are not permitted to reproduce, distribute or make the digital services publicly accessible.

9.3. In the event of discontinuation of the service, there is no entitlement to a refund or damages. The Provider reserves the right to discontinue the service at any time but will endeavour to inform customers in good time.

10. Liability

The Provider is not liable for any additional costs that may arise from the use of the forecasts offered. These are forecasts whose accuracy cannot be guaranteed.

11. Dispute resolution

The European Commission provides a platform for online dispute resolution (ODR), which you can find at http://ec.europa.eu/consumers/odr. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
